Regulatory Amendments Interpreting the California Fair Chance Act, Effective October 1, 2023: Impact on Background Investigations and Pre-Employment Processes for Public Entity Employers
The California Civil Rights Council has amended the regulations interpreting California’s 2018 Fair Chance Act, which go into effect October 1, 2023. The new regulations add restrictions, make clarifications, and significantly change the California background check process.
The amendments affect, among others, provisions of the law relating to the consideration of conviction history prior to and after a conditional offer of employment and employers’ obligations when taking adverse action because of conviction history.
We will cover all the details in the new regulations and more – with the objective of providing public entity employers with new requirements, confirming areas where public employers are exempt from the Fair Chance Act requirements, and strategies for refining your pre-employment practices.
