The Fundamentals of Government Liability and Investigations is a half-day course designed to educate its students about local agency’s government liability and investigations. Students will be introduced to the kinds of claims brought against public agencies, an overview of agency liability exposures, and investigation best practices. The course is designed for agency risk and human resources managers, maintenance, public works, parks and recreation, and other staff who manage and oversee possible liability risks. The course will provide an overview of relevant laws and best practices. The program is intended as an open forum with questions invited. It will include handouts made available to the participants.

Description: Contract Clauses and Insurance requirements is a half-day course designed to educate contracts managers and related staff about key favorable and unfavorable contract clauses found in agreements provided by vendors and in other agency contract documents. The program will also address contract insurance requirements and additional insured endorsements.

About The Instructor: A native Californian, Neal Meyers graduated with Highest Honors from California Polytechnic State University, San Luis Obispo, concentrating in local government. After that, he attended law school at the University of San Diego. Neal then embarked on a notable law career defending public agencies and businesses in claims ranging from excessive use of force to public works contracts disputes. In doing so, he earned the highest possible rating in legal ability and ethical standards from his peers. Neal contributed to the California League of Cities Municipal Law Handbook, and he lectured many times to small and large groups on government liability, contracts, and public works disputes. After close to 40 years of lawyering, Neal recently retired from active litigation, and he shares what he has learned and continues to learn with you.

Description

Compromise & Release (C&Rs) settlements resolve claims with a final lump sum settlement. The C&R allows employees to gain full control of their medical care, closes the claim (which allows for the elimination of the ongoing administration fees of a claim and unknown and adverse loss development), and allows employees to invest any applicable permanent disability benefits as they receive a lump sum payment versus biweekly payments. In addition to injured workers having more satisfaction regarding medical care control, there is a financial benefit to agencies and pools which utilize C&Rs. Join attorneys from Michael Sullivan & Associates to learn more about C&R settlement considerations and benefits.

Speakers:

Keith Figgins, a Bar-certified specialist in workers’ compensation, is senior partner of the Michael Sullivan Orange and Ontario offices. He has a significant caseload of files, representing hospital, municipalities, and school districts in all aspects of workers’ compensation. Mr. Figgins received his Juris Doctor from the University of Pittsburgh School of Law in Pennsylvania, and received his undergraduate degree from the University of La Verne, where he was on the Dean’s List and received a Governor’s Scholarship Award. Mr. Figgins is a sough after speaker, conducting trainings and seminars throughout the state.  He has worked to enact ADR programs in various municipalities, including providing training to claims examiners and paneled outside counsel.  Additionally, he has served as a consultant to guide municipalities through law changes and the impacts on their program.  

Laura Banker, a Bar-certified specialist in workers’ compensation, is a partner in the firm. She represents self-insured employers, third-party administrators, and corporations in all aspects of workers’ compensation and specializes in Industrial Disability Retirement (IDR) claims. Ms. Banker is also a member of the Massachusetts Bar. Ms. Banker received her Juris Doctor degree cum laude from New England Law in Boston, where she received the American Juris Prudence Award in Criminal Procedure. She received her undergraduate degree, cum laude, from California State University in Sacramento, where she served the Joint Legislative Prison Committee as a state senator’s staff member.

McKenna Watcher, associate attorney, specializes in self-insured employers and public entities in all aspects of workers’ compensation. She joined the firm as a law clerk, through the firms’ rigorous training program in association with IEA and Sullivan on Comp.  Ms. Watcher received her Juris Doctor degree from the University of La Verne College of Law where she won a CALI award in Business Organizations II and was President of the Sports and Entertainment Law Society. She also holds a B.A. in Communication and Political Science from the University of California, Santa Barbara. Ms. Watcher speaks fluent Spanish.
